Terms & Conditions for Moving Map Subscriptions

1. Introduction

Moving Map is a brand owned and operated by Spatiata (referred to herein as "us", "we" or "our"), for all intents and purposes Moving Map relates to the product/service being offered and Spatiata refers to the entity who owns Moving Map. Spatiata may offer products or services for sale to you ("you", "your") in connection with our website https://movingmap.com.au.
Purchasing a product or service from us means you understand and agree to these terms of service for the sale of any product or service.

2. Modification of these Terms

We reserve the right to update these terms and conditions at any time. Upon doing so we will notify the registered email address associated with the subscription and post about changes on our websites and/or social platforms. By remaining subscribed, you are considered to have accepted the terms & conditions changes displayed here.

3. Account Security

In order to purchase products and/or services from us, you will be required to hold an account with us. This account must include a valid email address with which an invoice can be delivered for receipt of sale and communication. You acknowledge that you are solely responsible for the level of security associated with your account. You must ensure your account will not be compromised and are responsible for all charges and/or purchases associated with your account.

4. Payment Method Terms

Our payment method is done through Square AU Pty Limited. We provide the option to use Google Pay in order to purchase products/services. By choosing a certain payment method, you hereby agree to the terms of the service by which you pay. Our payment provider may request personal details such as an email address in order to carry out a purchase. You hereby agree that your Moving Map supplied email address will be the email address supplied to Square AU Pty Limited to conduct the transaction.
Should our payment provider require additional details in order to conduct the transaction for products/services, you agree that you will provide them in the relevant format requested.
Should your payment method fail or be declined, we reserve the right to cancel your product/service until payment is made for the product/service. If you are having difficulty paying online, please contact accounts@movingmap.com.au for assistance.
We may impose additional fees upon the transaction in order to cover the cost of purchases done through third parties. We will include this cost within the price of the product or service. Should you wish to use an alternative method for payment, the price may differ to that which is advertised online.

5. Subscriptions

If you purchase a subscription to a product or service, you are hereby agreeing to a recurring charge being made to your chosen payment method for the duration specified. This recurring payment will commence on the date you make a purchase and will repeat monthly until it is cancelled. We may modify the price of subscriptions to reflect changing costs associated with providing a product/service. Upon doing so we will notify the registered email address associated with the subscription and post about price changes on our websites and/or social platforms.

6. Refunds

You are provided immediate access to products/services upon completion of a purchase. You do not have the right to a refund for change of mind, finding a cheaper product/service, or because you didn't like it or have a use for it. Subscriptions help to fund the platform and support the ability to continue to provide services with the platform. Whilst we may provide benefits for subscribers, by you subscribing it is considered to first and foremost be a support-based model which does not guarantee improved or enhanced outcomes. Benefits are not guaranteed and may vary. While we may showcase potential benefits of subscribing, this does not guarantee these benefits will apply to your specific circumstances or add meaningful value to you. This policy does not override your rights under any applicable laws or rights under the Australian Consumer Law.

7. Availability

We reserve the right to cancel or amend what is made available to subscribers as 'benefits' for subscribing. We shall have no liability for any decisions we make to add or remove any perceived benefits to the subscriptions. We cannot guarantee the accuracy of any benefits granted by being a subscriber. By subscribing you acknowledge that any benefits granted to you are not guaranteed and are subject to change or removal.

8. Taxes

We include all charges as part of the total cost for products/services. Australian customers will have 10% GST included. Other customers will not have GST included but will pay the same price. We cover the 2% payment processing fee. We do this to keep the price uniform with no hidden costs.
